Суд присяжных — одна из самых долгоиграющих тем для дискуссий среди украинских законодателей и юристов. Между тем, этот институт в наших краях уже существовал и действовал довольно успешно.

16 ноября 1867 года произошло открытие окружного суда, где слушались дела с участием коллегии присяжных заседателей. В Харьковской губернии было три таких окружных суда — Харьковский, Сумской и Изюмский.
Что говорил закон?
Обвиняемых в преступлениях, за которое было возможным присудить к лишению общих или особенных прав (что предусматривало тюремное заключение на срок от 1 года 4 месяцев и все более тяжкие наказания) судил суд присяжных под председательством одного судьи. Коллегия присяжных состояла из 12 действующих и 6 запасных заседателей. Присяжные избирались по сложной процедуре. Вначале составлялся широкий уездный список, включавший представителей всех сословий, обладавших определенным цензом. Затем комиссия уездного земского собрания отбирала узкий список. Далее из узкого списка жребием отбиралось 30 присяжных для серии процессов, из них для каждого отдельного процесса сторонами отводилось по 6 присяжных, а оставшиеся жребием разделялись на основных и запасных. Присяжные, следуя вопросам судьи, определяли наличие события преступления, виновность подсудимого, необходимость в снисхождении; судья определял наказание.
Присяжным заседателем мог быть мужчина из любого сословия в возрасте от 25 до 70 лет, умеющий читать по-русски и проживавший не менее двух лет в том уезде, где проводилось избрание в присяжные. Не допускались в присяжные находящиеся под судом и осужденные за деяния, влекущие наказание не ниже тюрьмы, а также не оправданные судебными приговорами за такие деяния; исключенные из службы по суду, из духовного ведомства за пороки и из среды обществ и дворянских собраний по приговорам своих сословий; несостоятельные должники и состоящие под опекою за расточительность; слепые, глухие, немые и лишенные рассудка; домашняя прислуга и впавшие в крайнюю бедность. От выполнения обязанностей присяжных также освобождались лица, занимавшие определённые должности.
Харьковские истории с участием присяжных
Однако не всегда удавалось собрать коллегию присяжных. 1 декабря 1910 газета «Южный край» писала: «Индифферинтизм присяжных заседателей, призванных отправлять правосудие, в последнее время снова достиг небывалых размеров… В течение 2-х почти часов суд и стороны тщетно ждали прибытия присяжного заседателя П. П. Тимченко и… не дождались. Видя создавшееся положение, явившиеся присяжные заседатели сами стали звонить по телефону к освобожденным судом присяжным заседателям Е. Д. Школяренко и И. Ф. Стеклеру, прося их приехать в суд, ибо в противном случае все назначенные дела будут отложены, причем по одному делу подсудимый уже находится до суда в тюрьме 10 месяцев… Г.Г. Школяренко и Стеклер изъявили свое согласие и прибыли в суд, и тогда только явилась возможность открыть заседание и приступить к рассмотрению дел. Неявившегося П. П. Тимченко суд оштрафовал на 25 рублей».
А вот что та же газета писала о человеке, оставившем след в истории города. 4 апреля 1912 в уголовном отделении окружного суда тов. прок. В. М. Воскресенский заявил суду, что присяжный заседатель Г. О. Гольберг, не явившийся для отправления своих обязанностей и представивший в удостоверение неявки медицинское свидетельство, принимает участие в заседаниях, но не судебных — председательствовал на собрании мелких промышленников и торговцев, которое было довольно бурным и затянулось до позднего времени. Так как суд, доверяя представленному Г. О. Гольбергом медицинскому свидетельству, признал неявку его для исполнения обязанностей присяжного заседателя законной, товарищ прокурора возбудил ходатайство о пересмотре определения суда и о признании причины неявки Гольберга незаконной. Да, речь идет о том самом благотворителе, на средства которого была построена Трехсвятительская церковь на Заиковке.
А вот пример слушания дела от ноября 1909 года. В уголовном отделении окружного суда, под председательством члена суда И. М. Лайминга, с участием присяжных заседателей, слушалось дело крестьянки Екатерины Озацкой, 18 лет, обвинявшейся в краже у своей хозяйки денег около 500 рублей. Девушка служила у г-жи Смирновой, на Кузнечной улице, и, воспользовавшись временным отсутствием хозяйки, похитила из комода деньги, после чего скрылась и была задержана только через несколько месяцев. Подсудимая судилась три раза за кражи. На суде она признала себя виновной в краже только 200 рублей и заявила, что 100 руб. она потеряла, 50 рублей истратила на свои надобности, а остальные деньги отдала взаймы своему дяде. Обвинителем выступал тов. прок. Е.Д. Плетнев. Защищал помощник присяжного поверенного Т. А. Кисличенко. Присяжные заседатели признали Озацкую виновной в краже на сумму более 300 рублей и дали снисхождение. Окружный суд приговорил подсудимую в тюрьму на 6 месяцев.
В таком виде суд присяжных просуществовал до принятия Декрета Совнаркома о суде №1 в конце 1917 года.
